General Terms and Conditions (GTC)

1. Definitions

1.1. The "Landlord" refers to AlpenApartment Zillertal (Corinna Sch.). The "Tenant" is the contracting party whose name appears on the booking confirmation. The rental objects are the apartments Edelweiss or Enzian of AlpenApartment Zillertal, located at Dörfl 365, A-6278 Hainzenberg.


2. Scope

2.1. These Terms and Conditions are part of the accommodation agreement. Deviating terms only apply if expressly agreed upon in writing for the individual case.

2.2. Unless otherwise stated below, the provisions of the Austrian Civil Code (ABGB) apply.


3. Offer and Acceptance

3.1. Offers made by the landlord are non-binding and reflect current availability at the time of inquiry.

3.2. The accommodation contract becomes valid only upon receipt of a deposit as per the payment terms. Once the payment has been received, a booking confirmation will be issued and sent to the tenant.


4. Payment Terms

4.1. All prices are in euros.

4.2. Advance payments are accepted only by bank transfer. On-site payments must be made in cash. Bank details will be provided upon reservation.

4.3. General payment schedule:

  • 30% deposit within 7 days after confirmed reservation
  • 30% of the total price 60 days prior to arrival
  • Remaining 40% upon arrival in cash or via bank transfer before arrival

4.4. For last-minute bookings made less than 30 days before arrival, the full amount must be paid within 7 days of invoicing.


5. Cancellation Policy

5.1. Cancellation by the tenant: Free cancellation is possible up to 30 days before arrival. For cancellations within the last 30 days, the full amount is charged. Late or incomplete payments may result in cancellation by the landlord, without prior notice, and the deposit will be retained as a cancellation fee. No-shows are also charged in full. We recommend purchasing travel insurance. Cancellations must be made in writing and are valid only upon written confirmation by the landlord.

5.2. Cancellation by the landlord: If payments are not made on time, the landlord may cancel the booking without notice. Deposits are non-refundable in such cases. In the event of unforeseen circumstances beyond the landlord’s control (e.g. sale of the property), the landlord reserves the right to cancel the contract. In such cases, all payments will be fully refunded.


6. Security Deposit

6.1. A security deposit of €200.00 must be paid in cash on arrival upon request. Damages caused by the tenant will be deducted from the deposit. Hidden or undeclared damages will be claimed by the landlord within one week after departure and pursued through legal channels if necessary.

6.2. Tenant liability for damages is not limited to the amount of the deposit.

6.3. Any remaining deposit will be returned in cash upon departure.


7. Check-in / Check-out

7.1. Check-in is possible from 3:00 PM on the day of arrival unless otherwise agreed. Check-out must take place by 9:00 AM on the day of departure.

7.2. Late check-out may result in an extra day being charged.


8. Number of Guests / Termination

8.1. The number of guests must not exceed the number of beds. The maximum occupancy is stated in the apartment description.

8.2. The tenant must provide the exact number of guests when booking.

8.3. If more guests are present than allowed, the landlord has the right to immediately terminate the rental agreement.

8.4. Early departures or late arrivals do not entitle the tenant to a price reduction.


9. Equipment

9.1. All dimensions and equipment descriptions are approximate and may vary.


10. Tenant Obligations

10.1. The tenant agrees to treat the property respectfully and use the furnishings properly. Rearranging furniture is not allowed.

10.2. The property must be kept clean and tidy, especially the kitchen.

10.3. Waste must be separated and disposed of in the designated containers.

10.4. Smoking is not permitted indoors. Cigarette butts must be disposed of properly outside.

10.5. Tenants must be considerate of neighbors, especially when using the garden or outdoor areas.

10.6. Misuse of the internet, including illegal downloads or false identification, is strictly prohibited (see Wi-Fi terms upon login).

10.7. Camping is not allowed on the property.

10.8. The surrounding meadows and pastures may not be entered – these areas are private property and not owned by the landlord.


11. Pets

11.1. Pets are not allowed under any circumstances.


12. Liability

12.1. The landlord is not liable for minor negligence. Liability is limited to the total cost of the stay. Exceptions apply to personal injury or consumer claims.

12.2. The tenant bears the burden of proof for the landlord’s fault.

12.3. The tenant must compensate for all damages caused by themselves or their guests.

12.4. The landlord is not liable for outages of utilities (water, electricity, internet, etc.) that are beyond their control. Any issue must be reported immediately to allow resolution.

12.5. The use of open flames or candles is strictly prohibited.


13. Valuables

13.1. The landlord is not liable for lost or damaged valuables. The tenant is responsible for the secure storage of their belongings.


14. Commercial Use

14.1. Published prices do not include commercial use of the premises (e.g. filming, photo shoots). Any such use must be individually negotiated and approved by the landlord.


15. Governing Law

15.1. Austrian substantive law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this applies only insofar as it does not restrict any mandatory legal provisions in the consumer's country of residence.


16. Special Notes

16.1. Stairways and outdoor areas require special attention. Parents are responsible for supervising children at all times. No child should be left unattended in outdoor areas. Please observe all guest information folders and brochures in the apartment.
